TERMS FOR FESTIVAL AND EVENTS
CODE OF CONDUCT
· Holder acknowledges that Festival has additional rules and requirements; all of them set forth in the Festival’s Code of Conduct, found in the Code of Conduct Tab below this section. All attendees (including ticket holders, sponsors, speakers, media, exhibitors and other participants) must abide by the aforementioned Festival’s Code of Conduct at all times. Anyone found to be in violation of any of such terms will be asked to immediately leave the Event, without refund.
DRINKING POLICY
· As responsible members of the community, Festival Organizers recognize the concern about drinking and driving, and its policy is to encourage responsible consumption of products at the festival. Attendees who consume alcoholic beverages must do so in a responsible manner. If Holder believes that his/her driving ability may be impaired or that Holder cannot safely operate a motor vehicle, please speak with a festival representative who will assist in securing transportation (at Holder’s cost) to Holder’s destination point. Due to the sheer number of Event attendees, neither the Festival Organizers nor the representatives of any Event venue can ensure that all attendees who intend to drive are capable of driving. Accordingly, Holder agrees to release, indemnify and hold harmless Organizer Representatives and the Event venue, as appropriate, from any liability related thereto.
WEAPONS-FREE POLICY
· Possession of any dangerous article, including but not limited to, firearms, destructive devices, explosives, slingshots, weapons, tear gas guns, electric weapons or devices and fireworks, are expressly prohibited at the festival in accordance with New York State Laws. Holder agrees that this policy is in force, and agrees to comply with the policy, regardless of whether signs prohibiting weapons are posted on the premises of any official Festival Event.
GOVERNING LAW
· Any claim arising from or relating to this Agreement, the Festival, or our dealings with one another, whether based in contract, tort, fraud or otherwise and regardless of the place of Holder’s residence, is governed by, and construed in accordance with, New York State law, without regard to conflict of laws principles, and venue shall lie in Queens County New York. If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
BINDING ARBITRATION
· All disputes arising out of this agreement shall be governed by and interpreted in accordance with the laws of the State of New York, without regard to principles of conflict of laws. The parties to this agreement will submit all disputes arising under this agreement to arbitration in Queens County, NY before a single arbitrator of the American Arbitration Association (“AAA”). The arbitrator shall be selected by application of the rules of the AAA, or by mutual agreement of the parties, except that such arbitrator shall be an attorney admitted to practice law in New York. No party to this agreement will challenge the jurisdiction and venue provisions in this section. The disputes shall be settled exclusively by arbitration and judgment maybe entered on the award in any court having jurisdiction Nothing contained within shall prevent a party from seeking injunctive relief.

Privacy Policy
DATA COLLECTION
· Upon accessing and using the Festival’s site, Holder acknowledges and agrees that Festival Organizers may AUTOMATICALLY COLLECT, STORE AND USE Holder’s information, including but not limited to, IP addresses, operating systems, referring web pages, locations, mobile carriers, devices used (i.e., cell phones, laptops, tablets, among others), search terms and cookie information (collectively, the “Derivative Data”) to help Festival Organizers diagnose problems and improve the Festival’s site for user experience. In order to purchase a Ticket(s), Holder acknowledges and agrees that Holder may be required to provide personal information such as, but not limited to, name, email address, mailing address, zip code, telephone number, date of birth, financial information, age verification and/or country of residence (collectively, the “Personal Information”). Holder acknowledges and agrees that Festival Organizers may COLLECT, STORE AND USE the Personal Information for legitimate business purposes, such as, but not limited to, processing Holder’s payment, fulfilling Holder’s order, updating Holder with the order status, shipping and tracking information, responding to customer service requests, and providing updated information to Holder respecting the Event, among others. Additionally, as a condition to gain access to the Festival and attend the Event, Holder of the Ticket hereby AFFIRMATIVELY, KNOWINGLY AND VOLUNTARILY CONSENTS to Event Organizers collecting, storing and otherwise utilizing Holder’s ID at the Event gates or other points of check-in for legitimate business purposes and in accordance with Event Organizer’s privacy policy including Holder’s photo, legal name, date of birth, sex, address of record, telephone number and any other personal information obtained from Holder’s ID. If we decide to change our privacy policy, we will post those changes on this page.
RIGHT TO USE YOUR NAME, VOICE, IMAGE AND LIKENESS
· By using this ticket, Holder hereby grants Festival Organizers and their affiliates and licensees the irrevocable, transferable, perpetual right and license to record (by photograph, film, tape, aural devices and any other method or device) the Holder’s name, voice, image and likeness while at the Festival (the “Recordings”) and publish, print, display, or use such Recordings for any and all purposes, in any and all media now known or hereafter devised. No drones or recording devices are permitted at the Event, except as approved in advance by the Festival Organizers.
PRIVACY POLICY
· The Pearls and Ivy Foundation of Queens, Inc. is committed to protecting the privacy of its users. This Privacy Policy describes how we collect, use, and disclose information that we obtain about visitors to our website (the “Site”) and the services available through our Site (the “Services”).
INFORMATION WE COLLECT
We may collect personal information about you when you use our Site or Services. The types of personal information we may collect include:

OPT OUT
· You may opt out of receiving promotional emails from us by following the instructions in those emails. If you opt out, we may still send you non-promotional communications, such as those about your account or our ongoing business relations.
SECURITY
· We take reasonable measures to help protect personal information from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction.
CHILDREN’S PRIVACY
· PIFQ does not knowingly collect or solicit any information from anyone under the age of 18 for this event. If we learn that we have inadvertently collected personal information from a child, we will delete that information as quickly as possible. THIRD-PARTY TRACKING AND ONLINE ADVERTISING
· We participate in interest-based advertising and use third-party advertising companies to serve you targeted advertisements based on your online browsing history and your interests. We permit third-party online advertising networks, social media companies, and other third-party services to collect information about your use of our Service over time so that they may play or display ads on our Service, on other websites, apps, or services you may use, and on other devices you may use. Typically, though not always, the information used for interest-based advertising is collected through cookies or similar tracking technologies. We may share a common account identifier (such as an e-mail address or user ID) or hashed data with our third-party advertising partners to help identify you across devices. YOUR CALIFORNIA PRIVACY RIGHTS
· If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of personal information to third parties for their direct marketing purposes during the immediately preceding calendar year. CHANGES TO OUR PRIVACY POLICY
· We may modify or update this Privacy Policy from time to time to reflect the changes in our business and practices, so you should review this page periodically. When we change the policy in a material manner, we will let you know and update the ‘last modified’ date at the bottom of this page. If you object to any changes, you may close your account. Continuing to use our Service after we publish changes to this Privacy Policy means that you are consenting to the changes.
Code of Conduct
All attendees must abide by the Festival’s Code of Conduct while on Queens College grounds. Anyone found to be in violation of any of such terms will be asked to immediately leave the event and will not be refunded.
We are committed to providing a safe and welcoming environment. We invite all sponsors, speakers, attendees, media, exhibitors, and other participants to help us create a safe and positive event experience for everyone.
Behavior
Please be courteous and respectful to those around you and refrain from behavior that interferes with others’ ability to enjoy the event. Refrain from demeaning, derogatory, discriminatory, or harassing behavior and speech. Be courteous and mindful of your surroundings and of your fellow participants. Alert event organizers or staff if you notice a dangerous situation or someone in distress. Attendees shall comply with all requests from Festival staff regarding emergency procedures. Always wear your wristband while at the event. Failure to have your wristband will result in you being asked to leave the event.
Unacceptable Behavior
Unacceptable behavior will not be tolerated whether by an attendee, media, speaker, volunteer, organizer, venue staff, partner, sponsor, or exhibitor. Any person or persons asked to stop unacceptable behavior is expected to immediately comply. If anyone is found to be engaging in unacceptable behavior, the event organizers may take any action they deem appropriate, up to and including removal from the event without warning or refund and if appropriate, involvement of local law enforcement.
Unacceptable behaviors include:
Intimidating, harassing, abusive, discriminatory, derogatory, or demeaning conduct by any attendee of the event or related event activities.
Physical or verbal abuse, intimidation, threats, annoyance, harassment, stalking, pushing, shoving or use of any physical force whatsoever against any person, which in any way creates a disturbance that is disruptive or dangerous, or creates apprehension, as determined by the festival and its event management, in their sole discretion.
Possession of a weapon or any item that can be used as a weapon, which may be used to threaten or cause injury to others if used in a certain manner.
Any destruction or vandalizing of personal property or event property or materials.
Any boisterous, lewd, or offensive behavior or language, using sexually explicit or offensive language or conduct, profanity, obscene gestures, or racial, religious, or ethnic slurs.
Possessing any outside alcohol or beverage or being intoxicated, as determined by the Festival’s organizers, in any area. Please drink responsibly.
Not wearing or displaying your wristband.
Possessing any illegal substance. The Festival does not tolerate the use or abuse of illegal substances anywhere in the event venues.
Smoking and/or vaping is not permitted on the festival grounds.
Assembling for the purpose of, or resulting in, disturbing the peace, or committing any unlawful act or engaging in any offensive behavior.
Any other illegal activity not already covered above.
Failure to obey any of the rules or regulations of the event venues or instructions of the event staff.
Only the following bag sizes will be permitted. This will ensure a safe and efficient experience.
Any bag that does not fall under the categories below could prevent entry into the event. Please note, we do not have bag check, storage or lockers.
